Making the decision to return to work after retirement should be considered carefully in light of how the employment will affect your pension benefit.  Below are guidelines regarding returning to work after you have retired:

• As an elected official, you may become elected or reelected from the same office from which you retired as long as one full term (from the same office that you retired from) has been satisfied.  If the full term has been satisfied, you will continue to receive the pension, you will not be a contributing member into the System, and you will not accrue credited service during re-employment.  However, the employer will be required to pay the System an Alternate Contribution Rate (ACR).

• If you become elected or reelected from the same office from which you retired that is less than one full term for that office, your retirement benefits shall be suspended during re-employment, you will not make contributions to the System, and you will not accrue credited service during re-employment.  Additionally, the employer will be required to pay the System an ACR and when you cease to hold the same office, the same pension benefit that you were receiving will be reinstated. 

Every retired judge may, if physically and mentally able, be subject to call by the Supreme Court or the Chief Justice of the Supreme Court to assist with cases on behalf of the court.  If the retired judge is temporarily called back to the active duties of a judge, they will be entitled to receive the same compensation and expenses as other like judges, less the retirement benefit they are receiving.

If you are a newly appointed or elected official and you do not have an active, inactive, or retired account with the EORP or the ASRS, you will be required to pay into the Elected Officials’ Defined Contribution (DC) Retirement System (EODCRS) plan. For additional information, see EODCRS.
