Part-time Law Enforcement Employment

Beginning June 30, 2026, Arizona law allows participating PSPRS employers to authorize eligible law enforcement officers, limited to sheriff deputies, municipal and department of public safety who are certified peace officers, to temporarily and voluntarily reduce their work schedule due to certain family-related circumstances while continuing employment and earning prorated PSPRS service credit.

TABLE OF CONTENTS

To participate, a law enforcement officer must:

  • Have at least three years of prior PSPRS credited service;
  • Experience a qualifying event;
  • Enter into a written agreement with the employer before beginning part-time service; and
  • Continue part-time employment until the specified end date communicated in the agreement

Qualifying events include:

  • The birth or adoption of a child; or
  • Providing care for a child, spouse, parent, grandchild or grandparent with a serious health condition

Part-time service under the program must:

  • Be between 20 and 30 hours per week;
  • Be established through a written agreement between the employer and member;
  • Last no longer than three years under a single agreement (PSPRS cannot apply credited service for part-time employment periods that exceed three years); and
  • Not exceed six total years of participation for any PSPRS member

Members participating in the program may not perform off-duty work and are expected to remain in part-time status for the duration of the agreement unless employment ends.

The law does not permit members to move back and forth between part-time and full-time employment during the agreement period.

Before approving participation, employers must verify with PSPRS that the member meets the three-year credited service requirement.

Employers are also responsible for maintaining records of hours worked during the agreement period and providing those records to PSPRS for service credit and contribution reconciliation following the end of the part-time agreement period.

In the event of a declared emergency or similar exigent circumstance requiring all members to return to full-time service, an employer may temporarily call participating members back to full-time duty.

PSPRS will calculate credited service on a prorated basis using hours reported by the employer during the agreement period.

For members who become eligible for an accidental, ordinary or catastrophic disability pension, average monthly benefit compensation will be calculated without including reduced earnings associated with participation in the part-time program.

  • New part-time service agreements must be executed before July 1, 2031.
  • No participation in the program may continue beyond June 30, 2034.

PSPRS review and approval

Employers must submit completed agreements to PSPRS for review and approval. Approved agreements will be maintained in member records for future service credit reconciliation, contribution reporting and payment.
